Terms and Conditions

Long story short - 

This is a simple guide to the main points in our Terms and Conditions.
The full Terms and Conditions still apply — this summary just makes the important stuff easy to understand.

 

1. We Follow the Rules

  • All flights follow FAA Part 107 regulations and any applicable state/local laws.
     

  • If your request breaks those rules, we can’t do it — even if you ask nicely.
     

 

2. FAA Approvals Can Take Time

​​

  • Some flights (like in controlled airspace, at night, or over people) need special FAA permission.
     

  • The FAA may take days or weeks to approve these. We’ll request them ASAP, but approval is not guaranteed.
     

  • If we can’t get approval, we’ll work with you to reschedule or adjust the plan.
     

 

3. Safety Comes First

  • We won’t fly in unsafe weather, near hazards, over people, or in risky situations unless legally authorized.
     

  • The pilot has the final say on whether a flight can happen at that moment.
     

 

4. You Have Some Responsibilities

​​

  • You need to secure permission for flights over private property.
     

  • Let us know about any hazards (like power lines or nearby airports).
     

  • For events, you’re responsible for telling guests that aerial photography is happening.
     

 

5. Payment and Cancellations

​​

  • A deposit may be required to lock in your date.
     

  • The deposit may be forfeited if you cancel within the agreed cancellation window, unless we reschedule.
     

  • Final payment is due when we deliver the finished work.
     

 

6. Who Owns the Photos and Video

​​

  • We keep the copyright unless otherwise agreed.
     

  • You get a license to use the content for your purposes, but you can’t resell or give it away without our permission.
     

 

7. If Things Go Wrong

​​

  • We aren’t responsible for delays or cancellations caused by weather, laws, equipment issues, or other factors beyond our control.
     

  • Our maximum liability is the total amount you paid for that job.
     

 

Bottom line:
We follow the law, keep safety first, and aim to deliver the best possible aerial imagery. If something outside our control changes the plan, we’ll work with you to find a solution.

Terms and Conditions – Jamestown Aerial Photography

Effective Date: 08/2025

 

1. Compliance with Laws and Regulations

1.1 All operations are conducted in accordance with the Federal Aviation Administration (FAA) rules and regulations, including Part 107 of the Federal Aviation Regulations.
1.2 Flights will comply with all applicable federal, state, and local laws, ordinances, and airspace restrictions.
1.3 Client requests that violate applicable laws, FAA waivers, or flight restrictions will not be fulfilled.

 

2. FAA Authorizations and Airspace Approvals

2.1 Certain flights may require prior FAA authorizations, such as operations in controlled airspace, night operations, flights over people, or other restricted conditions.
2.2 All required FAA authorizations will be requested as early as possible; however, the FAA may take days or weeks to process approval requests.
2.3 If FAA authorization is denied, delayed, or modified in a way that prevents the planned operation, Jamestown Aerial Photography will work with the client to reschedule or adjust the scope of work.
2.4 The client acknowledges that final flight approval is at the discretion of the FAA and that Jamestown Aerial Photography cannot guarantee that all requested operations will be permitted.
2.5 No refunds will be provided for completed portions of work if authorization delays or denials prevent completion of the original plan, unless otherwise stated in writing.

 

3. Safety for People, Animals, and Property

3.1 Flight operations will be conducted with the highest regard for the safety of people, animals, and property.
3.2 Drones will not be flown directly over people, moving vehicles, or sensitive areas unless legally authorized and operationally safe.
3.3 The pilot retains the right to adjust, delay, reschedule, or cancel flights at any time if conditions are deemed unsafe. This includes, but is not limited to, unsafe weather, hazardous obstructions, unexpected crowding, or wildlife activity.

 

4. Weather and Flight Conditions

4.1 Drone flights are subject to weather conditions such as wind, precipitation, visibility, and temperature.
4.2 Flights may be rescheduled without penalty due to unsafe weather or airspace conditions.
4.3 If a client insists on proceeding despite weather concerns, the pilot’s decision will be final.

 

5. Client Responsibilities

5.1 The client must obtain any required permissions for operations over private property and secure access to the work site.
5.2 The client must disclose any known hazards such as power lines, loose debris, radio interference, or restricted zones near the flight area.
5.3 For event coverage, the client is responsible for informing attendees that aerial photography/videography will take place.

 

6. Payment and Scheduling

6.1 A deposit may be required to reserve a flight date.
6.2 Final payment is due upon delivery of the agreed-upon media unless otherwise specified in the invoice.
6.3 Cancellation by the client within 3 days of the scheduled shoot may result in forfeiture of the deposit unless rescheduled.

 

7. Media Rights and Usage

7.1 Unless otherwise agreed in writing, Jamestown Aerial Photography retains the copyright to all captured media.
7.2 Clients receive a non-exclusive license to use the delivered media for the agreed purpose(s).
7.3 The media may not be resold, altered, or redistributed without written permission.

 

8. Limitations of Liability

8.1 Jamestown Aerial Photography will not be held liable for damages, losses, or injuries resulting from:

  • Acts of nature, equipment failure, or other events beyond reasonable control

  • Client negligence or failure to disclose hazards

  • Interruption or cancellation due to legal or safety concerns
    8.2 Liability for any proven claim shall not exceed the total amount paid by the client for the specific service.

 

9. Indemnification

The client agrees to indemnify and hold harmless Jamestown Aerial Photography, its employees, and contractors from any claims, damages, or expenses resulting from the client’s failure to comply with these Terms and Conditions, applicable laws, or third-party rights.

 

10. Amendments and Governing Law

10.1 These Terms and Conditions may be amended in writing with mutual agreement between the client and Jamestown Aerial Photography.
10.2 These Terms and Conditions are governed by the laws of the State of [Your State], without regard to conflict-of-law principles.

 

By engaging Jamestown Aerial Photography for aerial photography services, the client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
